  • We are bound by the National Privacy Principles contained in the Commonwealth Privacy Act 1988. All personal information collected and held by us will be governed by the most recently updated policy. This Privacy Policy was last updated on 7th July 2022.

  • Personal information includes information or an opinion that could identify an individual. What is personal information will vary, depending on whether a person can be identified or is reasonably identifiable in the circumstances. Personal information may include but is not limited to:

    • Your name, signature, address, phone number and date of birth

    • Sensitive information

    • Internet protocol (IP) addresses

    • Bank account details

  • Sensitive information is personal information that includes information or an opinion about an individual’s:

    • Racial or ethnic origin

    • Religious or philosophical beliefs

    • Health or genetic information

    Given the health services we provide, we will collect information necessary to treat you, which may include health or medical information. We do not collect sensitive information from you without your consent.

  • Anonymous dealings include an

    • Unidentified individual telephoning to inquire generally about our goods or services

    • Provision of feedback

    Given the health services we provide, it is impractical and sometimes impossible for us to deal with you through use of a pseudonym.

  • We collect your personal information to:

    • Respond to requests or queries

    • Confirm your identity

    • Effectively provide our health care services to you

    • Fulfil orders made by you

    • Keep you up to date with news, special offers, and other marketing information you haven’t opted-out of receiving.

    When you fill out a survey or send us feedback, we may ask you to provide certain information. It is completely optional for you to engage in these activities.

    Some information we ask you to provide may be marked as mandatory or voluntary. We may not be able to effectively provide our services if you do not supply us with this information.

  • Contact details and publishable content are collected when supplied by you through any means. Click trails are recorded by our servers as each request reaches the website. This includes but is not limited to: The type of browser you are using

    • The date and time of your visit

    • The address of the website that referred you to ours

    • The addresses of pages accessed, and any documents downloaded

    Click trails can be correlated over time using ‘cookies’. In most cases click trail data is not directly individually identifiable.

    Activity history is recorded whenever you undertake an activity such as submit an enquiry, make a comment, and may additionally be recorded by us when you contact us offline.

    Any information we receive about you that is unsolicited and is not necessary to us in providing our services to you will be destroyed or de-identified.

  • We hold some of your personal information on servers located onsite at our Clinic, and its service provider’s cloud platforms. As such any personal information provided to us may also be transferred to and stored at a destination outside Australia, including but not limited to Ireland, the United Kingdom and the United States. By providing us with your personal information, you expressly agree and consent to the disclosure, transfer, storing and processing of your personal information outside of Australia. In providing this consent, you understand and acknowledge that countries outside Australia do not always have the same privacy protection obligations as Australia in relation to personal information. We are required to take such steps as are reasonable in the circumstances to ensure that any recipients of your personal information outside of Australia do not breach the privacy principles contained within the Privacy Act.

  • We may disclose your personal information to third parties, and you consent to us disclosing your personal information to third parties, under the following circumstances:

    • As part of a sale of all or part of our business

    • When explicitly authorised to do so by yourself at the time you supply the information

    • As required or authorised by any applicable law

    • To other members of your treating team where necessary

    • To other health care professionals, if in our judgement that is necessary in the context of your treatment

    • To financial institutions for payment processing

    • To the government and other regulatory bodies such as Department of Veterans Affairs, Medicare, Transport Accident bodies and Workers Compensation bodies where necessary e.g. for processing reimbursements

    • Your employer, where required and permissible in relation to a work-related injury

    • As part of any investigation by us into you or your activity on our website (including to your Internet Service Provider or network administrator)

    • If we have reason to believe that you have committed a breach of any of our terms of use or have been otherwise engaged in any unlawful activity and we reasonably believe that disclosure is necessary (including to the Police or any other enforcement body, or to your Internet Service Provider or network administrator).

    • To lessen or prevent a serious threat to a person’s health or safety

  • When you submit content to us for publication (including but not limited to comments, testimonials, or tagged social media posts) you assign us a transferrable, perpetual right to publish and/or commercially utilise said content without limitation. You also warrant in submitting such content that the content is owned or produced by yourself, or you otherwise have permission to assign publication rights to us. Publication rights do not extend to fields specifically marked as private (e.g., your email address), except in cases of clear violations of our terms of use.

    Content submitted by you for publication may be disclosed to all visitors of our website, and/or republished on other websites and online platforms at our discretion.

    If you provide personal information either of your own or of any third party as part of publishable content, you warrant that you have permission to publish said information and indemnify us against any consequences resulting from the publication of said information.

  • If you use our website, we may utilise “cookies” which enable us to monitor traffic patterns and to serve you more efficiently if you revisit the site. Cookies are small text files which are downloaded on to your computer or mobile device when you visit a web site or application.

    A cookie identifies your computer, and certain types of cookies can identify you when combined with other personal information we hold about you.

  • You may opt out from the passive collecting of personal information by turning off cookies in your browser. Please note however that disabling cookies may result in a reduction of available functionality on our site.

    You expressly consent to us using your personal information (other than sensitive information), including any email address you give to us, to provide you with information and to tell you about our products, services, or events when you are a patient of ours (or otherwise request to receive such information) which we consider may be of interest to you. If at any time you do not wish to receive any further direct marketing communications from us, you may ask us not to send you any further information about products and services and not to disclose your information to other organisations for that purpose. You may do this at any time by using the “unsubscribe” facility included in the email or by contacting us. If you receive any communication purporting to relate to us or our products or services that you believe has been sent to you other than in accordance with this policy, or in breach of any law, please contact us.

  • We cannot guarantee the security of all electronic transmissions of personal information. You provide us information via the internet at your own risk. We cannot accept responsibility for misuse or loss of, or unauthorised access to, your personal information where the security of information is not wholly within our control. You agree that we are not responsible for the privacy or security practices of any third party and that the collection and use of your information by third parties may be subject to separate privacy and security policies.

    Notwithstanding the above, we will take reasonable steps to:

    • Ensure the personal information we collect, use or disclose is accurate, complete and up to date;

    • Protect your personal information from misuse, loss, unauthorised access, modification, or disclosure both physically and through computer security methods; and

    • Destroy or permanently de-identify personal information if it is no longer needed for its purpose of collection.

    However, the accuracy of personal information depends largely on the information you provide to us, so we recommend that you:

    • Let us know if there are any errors in your personal information; and

    • Keep us up to date with changes to your personal information (such as your name or address).

    We are required to comply with the notifiable data breaches scheme that commenced on 22 February 2018, should an eligible data breach occur in respect of the personal information we hold about you.

  • You have the right (excluding exceptions outlined in the Privacy Act) to seek access to and update or correct the personal information we hold about you. If you make an access request, we will ask you to verify your identity. We may charge a fee to cover the costs of meeting your request.
